Our prices and price lists are non-binding and may be changed at any time without prior notice. In the event of a price increase between the date of the order and the date of delivery, the price applicable at the time of the order shall be due and payable.
Any amount not paid on the agreed due date will be increased by law and without prior notice of default by an interest of 15% per year. In addition, each amount not paid on the agreed due date shall be increased by law by 15% with a minimum of € 125.00 as a fixed compensation for extrajudicial damage. The collection of outstanding invoices will take place automatically via Hoebeek Lawyers after the expiry of the payment term. For shipping and/or customised work, payment should be made in advance (paypal or bank transfer), and when picking up the order payments should be made in cash (except for customised work) or by bank transfer (no paypal).
The ownership of the delivered goods is only transferred to the buyer at the time of full payment of the price. Until such time, the goods can and may never be pledged or sold and Kussens-op-maat.be always retains the right to take back or claim the goods belonging to them. If Kussens-op-maat.be makes use of this right, this shall only imply a dissolution of the sales agreement when Kussens-op-maat.be expressly states this. In the case of confiscation of the goods, the purchaser must inform Kussens-op-maat.be of this.
The transport costs are automatically calculated during the checkout process. For large packages, the shipping cost may differ. In that case, you will be notified before the order is finalised. However, shipping costs are always communicated clearly during the order process. For larger orders there are no shipping costs.
The delivery times indicated on our website are indicative only and not binding. The deadlines are never binding and cannot under any circumstances give rise to compensation for any reason whatsoever. Our goods are always transported at the risk of the seller, unless you take care of the transport yourself. From the moment of delivery, the buyer bears the risk for the delivered goods, notwithstanding the retention of title as described in these general terms and conditions. The delivery status communicated by the transport company shall serve as proof of delivery.
If we are unable to produce and/or deliver due to force majeure or special circumstances beyond our control, transport difficulties or all kinds of conflicts (state of war, strike, lock-out, illegal occupation of premises and/or installations, etc.), we may refrain from further, full or partial execution of the order, or postpone the delivery to a later date than that agreed upon, without the customer being able to make any claim for compensation.
All our products are manufactured according to the design and dimensions you have provided. They cannot be resold. Therefore, it is important that you check your order details and product description before placing an order with us. Please note that covers/cushions cannot be exchanged or returned unless they have clearly been made incorrectly and cannot be corrected. A limited deviation (3%) on the entire circumference, especially for larger cushions, should be taken into account. Such deviations sometimes occur temporarily due to the shipping process. Refunds will of course be provided if your order cannot be completed. If, in the unlikely event that the customised cushions you ordered are delivered damaged or not in compliance, you should let us know in writing within 14 days. Please note that returns will only be accepted if agreed in advance and confirmed by us. In this case, the product must not be used, i.e. it must be returned in its original condition. Since our production process is registered, in most cases an error can already be detected by us after examining these data. In that case, we will organise a collection ourselves. In that case we only ask you to pack the products accordingly. If you have ordered the wrong product (size, colour,...), or if there are any doubts, the product must be returned via BPost at your own expense and packed accordingly. If it is your fault, we will do everything we can to rectify the situation at minimum cost. If the error is our fault, we will of course refund the shipping costs and rectification is free of charge.
Only the courts of Oudenaarde are competent to deal with disputes.
